Privacy Policy
This Privacy Policy (“Policy”) applies to the Drive Now App mobile application for iOS and Android and to the websites drivenowapp.net, www.drivenowapp.net and landing.drivenowapp.com (together, the “Services”), offered by Drive Now App (“Company”), operated by TwentyTwo Six LLC, and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to the Company include the Drive Now App and these websites.
Collection of your Personal Information
In order to better provide you with products and services offered, the Company may collect personally identifiable information, such as your:
- First and last name
- Mailing address
- Email address
- Phone number
- Age
We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use the Drive Now Smartphone app. These may include: (a) registering for an account; (b) verifying your identity using a one-time passcode sent to your phone number and email address when you sign up or reset your password; (c) sending us an email message to the parent/guardian of minors. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.
Use of your Personal Information
The Company collects and uses your personal information in the following ways:
- to operate and deliver the services you have requested
- to provide you with information, products, or services that you request from us
- to provide you with notices about your account
- to verify your identity and secure your account by sending you one-time passcodes (OTPs) by email, and also by text message (SMS) if you have opted in to texts, when you create an account or reset your password
- to send you text messages (SMS) about your account and your driving sessions, only if you have opted in to texts, as described in “Text Messages (SMS) and Verification Codes” below
- to carry out the Company’s obligations and enforce our rights arising from any contracts entered between you and us, including for billing and collection
- to notify you about changes to our Drive Now App or any products or services we offer or provide through it
- in any other way we may describe when you provide the information
- for any other purpose with your consent.
The Company may also use your personally identifiable information to inform you of other products or services available from the Company and its affiliates.
Sharing Information with Third Parties
The Company does not sell, rent, or lease its customer lists to third parties.
The Company may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (email, name, address, phone number) is not transferred to the third party. The Company may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to the Company, and they are required to maintain the confidentiality of your information.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, except the service providers that deliver our text messages on our behalf.
The Company may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Company or the site; (b) protect and defend the rights or property of the Company; and/or (c) act under exigent circumstances to protect the personal safety of users of the Company, or the public.
Automatically Collected Information
The Company may automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, access times, and referring website addresses to maintain quality of the service, and to provide general statistics regarding the use of the Company’s application and website.
Session Recording in the Mobile App
To understand how the Drive Now App is used and to find and fix problems, the mobile application may record your sessions. A session recording is a visual reconstruction of the screens you view and the taps and gestures you make while using the app. Recordings are made with PostHog, our product analytics provider, which processes them only on our behalf. Our websites do not record sessions.
What is hidden. Before anything leaves your device, the app masks the text you type, photos and images, names, phone numbers, email addresses, permit and license numbers, dates of birth, addresses, route maps and document previews. Recordings do not include the app’s console logs or the details of its network requests.
Who is recorded. Sessions of users 18 or older may be recorded. A user under 18, or a user whose date of birth we do not have, is recorded only while a parent or guardian linked to that student in the app allows it (Profile → Session recording). This is off until the parent or guardian turns it on. We keep a record of each choice: which parent or guardian made it, when, and the version of this Policy in effect.
Stopping and deleting recordings. A parent or guardian can turn recording off at any time. Recording stops the next time the student’s app is opened or brought back to the screen, and we delete that student’s recordings within 30 days. When an account is deleted, we delete its recordings within the same 30 days. Recordings are linked to your account so that we can find and delete them; you may also ask us to delete yours using the contact details below.
We do not sell session recordings or use them for advertising.
Use of Google Location Data
Our mobile application may capture and use Google Location data for specific purposes, including:
- Instructor Course Validation: To confirm that instructors are conducting sessions in approved and acceptable courses.
- Safety and Security: To enhance the safety and protection of both students and instructors during the use of our services.
We are committed to ensuring that location data is handled responsibly and securely. The data is only collected and processed as necessary for these purposes and is not shared with unauthorized third parties. By using the app, you consent to this collection and use of location data as described.
Text Messages (SMS) and Verification Codes
Text messages are optional. Drive Now App, operated by TwentyTwo Six LLC, sends text messages (SMS) only to users who choose to receive them, by ticking the optional checkbox on the sign-up screen (it is unticked by default), or by turning on Profile → Notifications → Text messages (SMS). Providing a mobile number alone does not sign you up for texts, and agreeing to receive texts is not a condition of creating an account or of any purchase. We record each choice with its date and where it was made. If you opt in, we send two kinds of messages:
- Verification codes. When you sign up for a new account or use the “Forgot Password” feature, we send a short one-time passcode (“OTP”) to the email address you provide, and also to your mobile number if you have opted in to texts. You enter the code in the app to confirm that you control that phone number or email address. Codes expire after a short time, can only be used once, and are stored in a protected (hashed) form.
- Account and driving session notifications. For example, when a practice drive starts, ends, or requires your confirmation, when an instructor grades a drive or updates a grade, or when an instructor account is approved.
Information we use. We collect your mobile number, the content of the messages we send you, and their delivery status. We use your phone number and email address only to deliver these messages and to confirm your identity.
Service providers. Messages are delivered through trusted third-party providers, such as our SMS delivery provider (Twilio) and our email delivery provider. These providers receive your phone number or email address solely to send the message on our behalf and may not use it for any other purpose.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, except the service providers that deliver our text messages on our behalf. These messages are transactional: we do not use your mobile number to send you marketing text messages.
Message frequency and charges. Message frequency varies based on your account activity; verification codes are sent only when you request one. Message and data rates may apply, depending on your mobile carrier plan. Carriers are not liable for delayed or undelivered messages.
Opting out. You may opt out of text messages at any time by replying STOP to any message or by turning off Text messages (SMS) in Profile → Notifications. For help, reply HELP or contact us at contact@drivenowapp.com or +1 (812) 814 0052. After you opt out, verification codes still reach you by email.
